Miscarriage Laws in India No matter what your feelings are about abortion,I cant imagine how anyone can justify forcing the emotional, financial and cost associated with a burial of a miscarriage on a woman who has just been through one of the most traumatic experiences a woman can have.
What a dangerous message to send to desperate women and girls, that if you cant financially afford, or endure the exposure of the burial of a lost pregnancy, you better go ahead and take care of things at home.
No women should be forced for miscarriage, if she has been forced , this is the crime in the law, if she voluntarily miscarriage then such action is not called to be crime.
Section 312 of IPC, 1860 – CAUSING MISCARRIAGE.
Whoever voluntarily causes a women with child to miscarriage , if such miscarriage not causes in good faith or for the purpose of saving life of the woman,
PUNISHMENT – imprisonment for 3 years and if women is quick to 7 years, and shall also be liable to fine.
SECTION 313 – MISCARRIAGE WITHOUT WOMEN CONSENT
If miscarriage occurred without women consent shall be liable to punishment for the imprisonment of life or for the either description for a term which may extend to 10 years, and also liable to fine
SECTION 314 – DEATH CAUSED BY ACT DONE WITH INTENT TO CAUSE MISCARRIAGE
If anyone does any act with intention to cause death of women, shall be punished with imprisonment of wither description for a term which may extend to 10 years and shall also be liable to fine.
Whoever before the birth of any child does any act with the intention of thereby preventing that child from being born alive, or causing it to die after its birth.
PUNISHMENT – if such act be not caused in good faith for the purpose of saving the life of mother, be punished for aterm which may extend to 10 years, or with fine or with both
SECTION 316 – CAUSING DEATH OF QUICK UNBORN CHILD BY ACT AMOUNTING TO CULPABLE HOMICIDE
If anybody caused death of a quick unborn child, shall be punished with imprisonment of either description for a term which may extend to 10 years and shall also be liable to fine.
Small children or unborn kids are the most precious gift a god can gave you, there are circumstances where a women cannot get pregnant due to such physical and internal issues, so if god has given you the chance to be a mother , respect it, and let every child get born in this beautiful world.
